FEES & TERMS:
The below fees & terms govern the engagement of Avitan & Associates, Inc., by the undersigned.
Professional Services Rates: Charged at $275/hour for all non-testifying time, including but not limited to: consultation, inspection, research, analysis, review, test, travel, etc. Depositions and trials charged at $400/hr, with a minimum of four hours. Professional services are billed in time increments of one-quarter (1/4) of an hour.
Expedited Services: New matters requiring analysis, report, deposition and/or trial testimony within 30/15 days of retention will be billed at a premium of 25%/50%, respectively, above the listed rates.
Continuous Out-of-Office Time: Matters requiring continuous out-of-office (i.e., overnight) travel will be billed at 10 hrs per day minimum, for all days out of office.
Travel Expenses: Billed at cost; Driven mileage of personal vehicle at $0.50/mile; Airport parking at $1/hour; Air travel in excess of 2-1/2 hrs will be booked in business or first class, whichever is least.
Project Expenses: Photography at $4.00 for 8-1/2"x11" originals, $2.50 for subsequent copies, and $1.50 for digital format plus $10 for CD; Photocopy at $0.18/page; Braking Distance Measurement Instrumentation (i.e., Chalk Gun & Speed Trap) at $168/day; Laboratory & Instrumentation quoted per assignment.
Outside Services: Billed at cost plus 20%.
Engineering Development Projects: Quoted on a case-by-case basis.
Retainer: Required prior to commencement of any work, deposition and/or trial. Unused funds will be refunded.
Time-Loss Fee: Inspection, deposition or trial, cancelled or re-scheduled within two (2) business days of said scheduled activity/appearance, is subject to a four (4) hour Time-Loss Fee at the rate published above.
Billing: Monthly, or at completion of work phase, submitted electronically (mailed hardcopy by request).
Terms: All balances are due upon receipt of invoice. Late Payment: 1-1/2% per month on unpaid balances after 30 days.
Notice: Rates, terms, and conditions listed herein are subject to change without notice.
Cancellation: Avitan & Associates, Inc., reserves the right to terminate work for non-payment of fees, costs, and/or late payment charges.
Automatic Termination: Matters not having activity for a period of 24 months from time of last activity by Avitan & Associates, Inc., shall be considered dismissed, abandoned or settled, and are subject to the immediate destruction of all subject materials, including but not limted to the destruction of evidence received, without prior written notice given to or received by Avitan & Associates, Inc.
No Guaranty: With respect to the services that Avitan & Associates, Inc., provides pursuant to this engagement, undersigned acknowledges and understands that Avitan & Associates, Inc., makes no representations concerning the outcome or result of any matter, or the amount of fees and expenses that will be incurred.
Governing Law: This agreement shall be governed by, enforced under, and construed in accordance with the laws of the State of Georgia.
Conflict: In the event the undersigned retained Avitan & Associates, Inc., through a third party company, the terms and conditions of this contract shall have control over the terms and conditions of the contract executed with the third party company if the two contracts are in conflict.
